Liveink Terms of Service

1. Who these terms are between

These Terms of Service ("Terms") are between you and App Dexter Limited, Rm C, 7/F, World Trust Tower, 50 Stanley Street, Central, Hong Kong ("we", "us"), who provide the Liveink app and service ("Liveink"). By creating an account or using Liveink you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use Liveink.

2. Who can use Liveink

• You must be at least 16 years old. If you are under the age of majority where you live, you confirm that a parent or guardian is aware you use Liveink.
• You must be able to form a binding agreement and not be barred from using the service by law or by us.
• We may ask for or check your year of birth. Providing a false age is a breach of these Terms.

3. Your account

• You can start with a random account; you may link Google or Apple sign-in, or create a recovery code, to get back in later. Keep your sign-in methods and recovery code safe: anyone who has them can use your account, and we cannot always recover an account that has no recovery method.
• Your invite code and link let people send you a friend request. Share them only with people you know. You are responsible for what happens under your account.
• One person, one account. Do not sell, rent or transfer your account.
• Tell us at [email protected] if you think your account has been misused.

4. Your content

• It stays yours. Drawings, captions, messages, reactions, profile photo and anything else you create or send ("Your Content") belong to you (or you have the rights to use them). We do not claim ownership.
• What you allow us to do. You give us a limited, worldwide, non-exclusive, royalty-free licence to store, copy, process (for example resize or re-encode) and transmit Your Content, and display it to the friends you send it to, only to run Liveink for you: delivering it to those friends, showing it in their app, widgets and Memories, keeping your Memories, handling reports and keeping the service safe and working. We do not use Your Content for advertising, we do not sell it, and we do not show it to anyone you did not send it to, except as described in section 6 and the Privacy Policy.
• When it ends. The licence ends when you delete the content or your account, except for copies that cannot be removed immediately (for example drawings already on friends' phones, reports kept as evidence, and logs that expire as described in the Privacy Policy), and what the law requires us to keep. Messages are kept until you delete them (or the sender takes them back within 24 hours) and are deleted when either account is deleted.
• You are responsible for Your Content. Friends who receive a drawing may save it or take a screenshot; send only what you are comfortable with. Only send content you have the right to send.

5. How to behave

No tolerance for objectionable content or abusive users: we remove content and ban accounts that violate these rules; you can report and block any user in the app.

You agree not to use Liveink to:

• send anything unlawful, or anything that sexualises, exploits or endangers a child. We have zero tolerance for this, will remove it and may report it to the authorities;
• send sexually explicit content, graphic violence, or content that promotes self-harm, terrorism or hatred;
• harass, threaten, bully, stalk, impersonate or deceive others, or send content to someone who has asked you to stop or has blocked you (or try to get around a block);
• send spam, mass friend requests or anything unsolicited, or collect information about other users;
• infringe other people's rights (copyright, privacy, likeness). Do not send someone's photo or likeness in a way that harms them or without any right to do so;
• break, probe, overload, scrape or reverse engineer Liveink, bypass its limits or age checks, use bots or automation, or interfere with other users' use;
• use Liveink for any commercial purpose without our written permission.

6. Reports, moderation and safety

Liveink is private, but not unmoderated. Users can block and report people and content; when someone reports something, we receive a copy of what was reported (see the Privacy Policy) and a person may review it. We may hold back content during a review, remove content, warn, suspend or end accounts that break these Terms or put others at risk, and we may share information with the authorities when the law requires or to protect someone from serious harm. We do not have to monitor content and we do not promise to find every problem.

7. Ending your use

• You can stop at any time and delete your account in the app (Settings, bottom: Delete account) or by emailing [email protected]. Deletion takes effect immediately; see the Privacy Policy for what is deleted and what remains.
• We may suspend or terminate your account or access, with or without notice, if you break these Terms, if required by law, or if we stop offering Liveink. Accounts with no friends that are unused for 90 days are deleted automatically. If we end your account for a reason not related to your conduct, we will tell you where we can.
• Sections that by their nature should survive (for example 4 on retained copies, 10, 11 and 13) continue after termination.

8. Liveink Plus and subscriptions

• Liveink Plus is an optional paid subscription that unlocks all 10 sticker packs (two sticker packs are free) and a larger friend list (free accounts can have 20 friends). Core features, including receiving and viewing your friends' drawings, are not meant to be locked behind payment. The price, length and features of each plan are shown in the app before you buy.
• Payment and renewal. You buy through Google Play or the Apple App Store, which handle payment and billing; their terms apply. Plans are monthly or yearly. Payment is charged to your Apple ID account (App Store) or Google Play account at confirmation of purchase. Subscriptions renew automatically at the end of each period at the price shown, unless you cancel at least 24 hours before the end of the current period; your account is charged for renewal within 24 hours before the end of the current period. Liveink does not offer a free trial.
• Cancel in your store's subscription settings (Google Play: Payments & subscriptions > Subscriptions; Apple: Settings > your name > Subscriptions). Deleting the app or your Liveink account does not cancel a store subscription. After you cancel you keep Plus until the end of the period you paid for.
• Refunds are handled by Google or Apple under their policies, not by us; we cannot refund store payments ourselves. Nothing here limits any refund or cancellation right you have by law.
• Where Plus is free. Liveink Plus is free of charge for users in Vietnam (decided by the country of your store account, or your network location if that is unknown); nobody there needs to pay or subscribe. In those places the purchase button is disabled; anyone who already has an active subscription can still manage or cancel it. Where Plus is paid, only the premium sticker packs and the larger friend list need it; everything else stays free. The Mac app does not sell subscriptions; a Plus bought on iPhone or Android applies there too.
• You can see your plan, renewal date and manage or cancel it at any time from Settings > Liveink Plus > Manage subscription, which opens your store's subscription page.
• We may change prices or plans; a price change applies to you only as the store's rules allow and after any notice they require.

9. Third-party services

Liveink relies on services we do not control, such as Google Play, the Apple App Store, Google and Apple sign-in, push notification services and your phone's operating system. Their terms apply to your use of them.

10. Disclaimers

Liveink is provided "as is" and "as available". We try to keep it running but do not promise that it will be uninterrupted, error-free, secure, or that drawings will always be delivered, stored or kept (for example, Memories can be lost by a fault, and latest drawings are kept 30 days). Keep your own copy of anything important. To the extent the law allows, we disclaim all other warranties. Nothing in these Terms limits rights you have as a consumer that cannot be limited by law.

11. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental or consequential loss (such as lost data, lost profits or distress) arising from your use of Liveink or from other users' content or conduct, and our total liability to you for any claim about Liveink is limited to the greater of the amount you paid us in the 12 months before the claim and USD 50. This does not limit liability that cannot be limited by law, including for death or personal injury caused by negligence, fraud, or intentional misconduct, or any mandatory consumer protection.

12. Changes

We may update Liveink and these Terms. We will post the new Terms on this page with a new date and, for important changes, tell you in the app where practical. If you keep using Liveink after changes take effect, you accept them; if you do not agree, delete your account.

13. Governing law

These Terms are governed by the laws of the laws of the Hong Kong Special Administrative Region, with the courts of Hong Kong having jurisdiction, and its courts will handle disputes, without taking away any mandatory protection you have under the law of the place where you live. If a part of these Terms is found unenforceable, the rest stays in force. These Terms and the Privacy Policy are the whole agreement between us about Liveink.
